Terms of Use

1. Acceptance and scope

These Terms of Use form an agreement between you and the independent creator publishing under the name VelvetTK ("VelvetTK," "we," "us," or "our"). They apply to velvettk.com, VelvetTK games, and related online features that link to these Terms (together, the "Services").

By entering the website, selecting an acceptance button in a game, connecting a membership account, or using a Service, you confirm that you have read and accept these Terms. Our Privacy Policy explains how personal data is handled and is incorporated by reference for notice purposes.

2. Adults only

The Services are intended exclusively for adults. You must be at least 18 years old and at least the legal age of majority in every jurisdiction that applies to you. You must not access the Services if adult sexual content is unlawful where you are located. We do not knowingly offer the Services to or collect personal data from minors.

You may not misrepresent your age, allow a minor to access the Services through your device or account, or attempt to bypass an age, location, membership, or access control.

3. Mature fictional content

The games may contain explicit sexual content, BDSM themes, restraint, fetish content, and depictions of consensual adult role-play. All characters, dialogue, events, and scenarios are fictional, and every depicted character is 18 years of age or older.

Names, characters, groups, organizations, places, events, and identifying details are fictitious. Any resemblance to an actual person, living or dead, or to a real entity, location, or event is coincidental unless expressly stated otherwise. VelvetTK does not endorse, encourage, or instruct anyone to perform non-consensual, abusive, dangerous, or unlawful conduct in real life.

Fictional depictions are entertainment, not a substitute for real-world communication, informed consent, safety precautions, professional advice, or compliance with local law. You are responsible for deciding whether the content is appropriate and lawful for you.

4. Companion AI disclosure

Companion dialogue and voice may be generated by artificial intelligence. You are interacting with a fictional AI-controlled character, not a human. AI output may be inaccurate, repetitive, unexpected, or offensive and must not be treated as factual, medical, legal, psychological, relationship, or safety advice.

To generate a reply, the managed service may transmit your companion guidance, current prompt, selected recent gameplay events, recent dialogue, and an optional journal summary to Firebase and the configured model provider. Do not enter a real person's confidential information or unnecessary identifying, financial, health, or other sensitive data. Additional details and consent controls are shown before the feature is enabled and in our Privacy Policy.

5. Membership authentication and AI credits

Certain features require a current eligible membership verified through an available provider such as Patreon or SubscribeStar. The connection is used only to authenticate you, verify the relevant subscription or tier, create a Firebase session, and administer access and AI usage credits. With your authorization, Patreon provides your account email, display name, account identifiers, and membership details. VelvetTK stores the email in Firebase as a long-lived identifier for the associated membership and support record. It is not used for marketing without separate consent. VelvetTK does not process your membership payment and does not request your provider password, payment-card number, or shipping address through this connection.

AI credits are a limited, revocable service allowance. They are not money, property, stored value, or a transferable benefit; they have no cash value, do not roll over, and may be subject to per-request, daily, membership-period, provider, technical, or abuse limits. Ending or losing the qualifying membership may end access. Membership charges, refunds, and cancellations remain governed by the membership provider's own terms.

6. Permitted use and prohibited conduct

You may use the Services only for lawful, private entertainment. You must not:

• use or expose the Services to any minor;
• submit content involving actual minors, exploitation, trafficking, or real non-consensual conduct;
• use AI output to harass, threaten, impersonate, exploit, or violate another person's rights;
• upload or submit another person's private information without authority;
• circumvent access, credit, security, geographic, or provider controls;
• probe, disrupt, reverse engineer, automate abuse of, or gain unauthorized access to the Services; or
• copy, redistribute, sell, publicly perform, or create unauthorized derivative works from protected Service content.

7. Intellectual property

The Services and their original software, characters, artwork, audio, text, branding, and other content are owned by VelvetTK or used under permission and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use a lawfully obtained copy of a game for private entertainment.

Third-party names, trademarks, platforms, libraries, and services remain the property of their respective owners. References to them do not imply sponsorship or endorsement.

8. Third-party platforms and links

The Services may link to or depend on Cloudflare, Google Firebase, Patreon, SubscribeStar, Replicate, Vimeo, itch.io, and other third-party services. Their separate terms, privacy practices, eligibility rules, and availability apply when you use them. We do not control third-party services and are not responsible for their independent acts or content.

9. Availability, changes, and termination

We may modify, suspend, limit, or discontinue a Service, feature, model, voice, credit allocation, or membership requirement for maintenance, safety, legal, provider, cost, or operational reasons. We may suspend access when we reasonably believe these Terms, law, provider rules, or Service security have been violated.

10. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, non-infringement, or compatibility. We do not guarantee that an AI response will be accurate, appropriate, or available.

Nothing in these Terms excludes a warranty, remedy, or consumer right that applicable law does not allow the parties to exclude.

11. Limitation of liability

To the fullest extent permitted by law, VelvetTK will not be liable for indirect, incidental, special, consequential, or punitive loss, lost data, lost profits, or loss arising from third-party platforms, unauthorized use, or reliance on AI output. Any limitation applies only to the extent lawful and does not limit liability that cannot be limited, including mandatory consumer protections.

12. Changes to these Terms

We may update these Terms to reflect Service, provider, security, or legal changes. The effective date above will be updated. Material changes may be presented in the game or on the website and may require renewed acceptance before continued use.

13. Governing rules and mandatory rights

These Terms are governed by the laws applicable where VelvetTK is established, without regard to conflict-of-law rules. This choice does not deprive you of mandatory consumer rights or protections that apply in your country of residence. You remain responsible for complying with local rules governing adult content, online services, and AI use.
